VIC Guide

Planning Permit vs Building Permit (VIC)

One controls what you’re allowed to build. The other controls how it’s built. Confusing them is one of the most common causes of owner-builder delays in Victoria.

General information only. Always confirm requirements with your local council or building surveyor.

In 30 seconds

  • A planning permit is about land use and neighbourhood controls.
  • A building permit is about construction compliance and safety.
  • You may need both, or only a building permit — depending on the project.
  • Getting them in the wrong order is a common (and expensive) mistake.

What is a planning permit?

A planning permit is issued by your local council and controls how land can be used and developed.

It focuses on neighbourhood and policy impacts — not construction details.

Common planning triggers
  • Zoning restrictions
  • Overlays (heritage, vegetation, flooding, etc.)
  • Building height, setbacks, site coverage
  • Neighbourhood character considerations

What is a building permit?

A building permit authorises construction work to start and confirms the work complies with the Building Act, Building Regulations, and NCC.

In Victoria, building permits are issued by a registered building surveyor — not council (unless the council also provides surveying services).

Building permits cover
  • Structural adequacy
  • Fire and safety provisions
  • Health and amenity requirements
  • Mandatory inspection stages

How they work together

  1. Confirm whether a planning permit is required
  2. If required, obtain planning approval first
  3. Prepare construction documents consistent with planning conditions
  4. Apply for a building permit
  5. Start work only after the building permit is issued
Important
A building permit cannot override planning controls. Your building surveyor will check consistency with planning approvals.

Common mistakes owner-builders make

  • Assuming a building permit means planning approval isn’t needed
  • Designing in detail before checking planning controls
  • Applying for a building permit before planning conditions are resolved
  • Starting work before the building permit is issued

Where this fits in the VIC owner-builder process

  1. Decide if owner-building is suitable
  2. Confirm Owner-Builder Certificate of Consent (if required)
  3. Work out planning permit requirements
  4. Appoint a building surveyor and obtain a building permit
