After Completion & Selling (NSW)

Owner-builder responsibilities don’t always end on completion — but they’re often misunderstood, over-emphasised, or worried about far too early.

First: what “after completion” actually means

“After completion” doesn’t mean the moment tools leave site. In NSW, it generally refers to the period after the final approvals are issued and the building can be lawfully occupied.

Important reset
If you are still preparing to start an owner-builder project, note that construction-phase responsibilities (insurance, site control, inspections) are usually far more immediate and risky than post-completion obligations.

Occupation approval is the key milestone

In practice, “completion” usually means obtaining the relevant occupation approval (often an Occupation Certificate).

  • Final inspections have been passed
  • Required compliance certificates are provided
  • The building is legally fit to occupy

Selling after owner-building: high-level reality

Selling a property you’ve owner-built can involve additional disclosure or obligations — but this depends on timing and circumstances.

  • Not every sale triggers extra requirements
  • Obligations are often time-based
  • They are separate from construction-phase responsibilities
Perspective matters
Many owner-builders fixate on selling implications too early. At the start of a project, this information is usually contextual, not urgent.

Common myths (and why they’re misleading)

“I can’t sell for years”
There is no blanket prohibition on selling. Timeframes matter, but context matters more.
“I must get warranty insurance no matter what”
Warranty requirements depend on timing, value, and sale circumstances — not every owner-builder sale is the same.
“Everything becomes my liability forever”
Responsibility exists, but it isn’t unlimited or detached from time, facts, or evidence.
“This is the most important part to get right early”
For most projects, getting approvals, insurance, and inspections right matters far more at the beginning.
